Town of QuartzsiteArizona Police Report

Today, July 13 2011, approximately 9:10am, at the QuartzsiteTown Hall, Quartzsite Assistant Town Manager Al Johnsoncommitted A.R.S. 13-1202. Threatening or intimidating  and A.R.S. 13-2402. Obstructing governmental operations.   Al Johnsonstepped into my path to the reception area and detained me for 35 seconds, while speaking to me in a manner indicating that indicated he expected my immediate departure from the building, and that I was no longer here to do any business, and his stance and posture and gestures appeared threatening.  During my visit, Johnson said several times I was loitering, (while waiting for police).

I had first enteredQuartzsiteTown Hall, walked to the reception window. The receptionist took my papers to stamp as received. I had brought a one page complaint about a missing stop sign at the corner at the police building location.

A sign is posted on the glass partition there: “No Video or Cameras”. There is no indication how far that zone extends, because you can even read it from the adjoining library. I have made previous written complaints about the sign.

I began a discussion withAl Johnsonat the window, which led to the hallway because Johnson was going to get the police guard on duty. I still was not sure where the boundary of the “no camera zone” was. Johnson would not respond to my question about that boundary. Alex Taft came along through the hallway, so I asked her to tell me where the boundary is. I had lengthy discussion, there in the reception area, with Johnson and mostly Alex Taft about the rules for camera use in that area.

Satisfied, I decided to return to the counter to get my papers and go. Johnson told me my business in town hall was finished. “No, it’s not” I responded. “What business do you have?” “None of your business”. I moved toward the counter. He stepped into my path. “Get outta my way”. He persisted in blocking me. Since the (armed) female police Sergeant Garcia, was within ten feet, I demanded that the sergeant remove Johnson from my way, but she declined. I made an immediate cell phone call to9-1-1from where I stood, and described my situation to the dispatcher. I was told they could only send more Quartzsite police. “Go ahead, send more”. “Can you also ask the sheriff to respond?” Affirmative, they will request. Johnson now moved out of the way. I retrieved my papers, waited long enough for more Quartzsite police. Sgt. Frausto came into the building, shook someone’s hand, but ignored me. Sgt. Garcia agreed to my request to send the sheriff to my home if they appeared. I left the building. No further police or sheriff contact.

There were several witnesses, the closest probably was Sgt. F. Garcia. Other witnesses were possibly Alex Taft, Tona. I witnessed Mr. Johnson’s offense. Offered as evidence is a potential surveillance video recording from the town’s system. Also I have video recording in my possession of the blocking incident. Jose Lizzaraga Charged With Disorderly Conduct

On May 24 2011, approximately 7:25pm, at the Quartzsite Town Council regular meeting held within town hall, former Quartzsite Town Council member Jose Lizzaraga committed disorderly conduct under A.R.S. 13-2904. Disorderly conduct. Former council member Jose Lizzaraga left his council member seat to make an announcement regarding fireworks. This was during the “call to the public” portion of the7 pm Quartzsite Town Council meeting ofMay 24 2011. He was awarded the floor by the presiding officer. His conduct was substantially like that of Jennifer Jones on June 28.

Community standards for this offense have been recently defined by the actions of the Quartzsite town council and the police chief. A speaker at the public podium during a town council meeting must not turn away from facing the mayor and council, to face the public seating area of the meeting room.

Turning one’s back to the council has recently led to an action by police, followed by charges of disorderly conduct against the citizen. Please refer to the well publicized arrest of Jennifer Jones onJune 28, 2011. Clearly it was her physical actions, not the actual words spoken, that led to a disorderly conduct charge against Jones. I stood and read a transcript of her exact words, at the next meeting of council. I was not bothered by police who were present.

I witnessed Mr. Lizzaraga’s offense. Offered as evidence is a video recording in my possession and which will soon be placed online for public viewing. Substantial other video recording was done by other independent attendees at the meeting.

Alex Taft Charged Regarding Private Press Interview

OnJuly 12 2011, approximately10:55 am, after the Quartzsite Town Council special meeting held within town hall,  Quartzsite Town Manager Alex Taft committed an unknown violation, to be discovered.

Taft is guilty of breaking the rule which she herself set. Some time ago, she ordered a sign be placed near the secure door at the entry to the office area. Subsequently staff enforced the rule for all other members of the public. Unnamed reporters from Channel 3 and Channel 15 news ofPhoenix, conspired with Taft and quietly entered the area with video cameras, for the purpose of conducting an interview with Taft. I was not allowed entry to the interview  when I inquired if a back room meeting was going on, and was told it was “none of my business” by assistant town managerAl Johnson. Johnson knows my interest was in reporting for my internet blog.

This is a serious charge, because just last Friday,July 8 2011, current chief of police Gilbert, 2 sergeants, and 1 more officer came to town hall to stop me from using my own video camera from just outside the forbidden area. This kind of response indicates a serious criminal act is suspected. I told the officers some history. In the last several months, I had filed two or more written complaints with Alex Taft, to inquire what authority the town has to forbid camera use. I believe camera use should be permitted, and apparently so does Taft. Taft’s offense was substantially the same as mine. It caused Gary, staff member in town hall, to call police. I am calling on the police.

During the morning, other Quartzsite town officials gave interviews in public, in the public meeting room. Taft granted an interview, in her office, to “the real reporters” [these were the words of current police chief Gilbert who denied me any information while the private press meeting was in progress. Gilbert knows my interest was in reporting on my internet blog]. Taft’s office is within the area designated by signage to be an area where video or camera use is forbidden.

I asked both Johnson and Gilbert if cameras were in use in that meeting? No response from either man. I had a video camera in my hand, and I believe that Johnson and Gilbert each had cameras on their person, in their cell phones.

On July 12, I inquired ofAl Johnson“just where does the no-camera area end? Am I still in it?” Standing at the reception window, I stepped back. Johnson would not answer my question. The sign faces the public side of the reception window. It does not indicate if a person who might read it from the library across the hall may or may not use a camera. It is a sign with vague meaning which has been solidly and consistently enforced, but in a vague manner.

Evidence: The video was shown on television broadcasts. Taft is seated at her desk talking to unnamed reporters who are using video cameras. Evidence in the form of video with audio recording is offered, in the possession of Channel 3 news ofPhoenix. Other video recording may have been taken by Channel 15 news of Phoenix or others.

There may be other offenses for further charges. I request that a full investigation be made to disclose any other offenses. The prosecutor should be consulted. It should be noted that documents in Taft’s office were visible in the video which was broadcast to the public. The town staff and officials have always otherwise been sensitive to allowing potentially confidential material to be viewed by non-employees. Examples of acts of document protection can be cited and documented from last December and last month.
