Today about 12:30 Al Johnson acted again, with police sergeant Frausto in tow. Johnson served a single page legal style document, bearing the name of the Magistrate Court of Quartzsite Arizona, titled “Complaint” on Jennifer “Jade” Jones. It detailed 4 misdemeanor counts related to the business she attends on Main Street. Johnson insisted that Jones must appear in court immediately, although the document was not accompanied by a court summons. He stated “If you’re not in court today, … I suggest that you show up”. It appeared to bear the original signature of Martin Brannan, Town Prosecutor. After the “service” was completed, Johnson reached over the fence again, to place the complaint in a more attractive position. Johnson remained on the property and did not seem ready to leave after he was told to go. “Goodbye Al”. Then Johnson was heard giving legal advice to Jones: “ …you don’t have the same expectation of privacy”. Johnson is the assistant manager for the town. It appears that he would be disqualified to serve process for a case in which he is a party to the action. The complaint seems to stem from his department. It also appeared that the court had not issued the document, as there was NO case number, nor the usual stamp indicating that it had been filed with a court clerk. See the document HERE.

ARS 13-2814. Simulating legal process; classification
A. A person commits simulating legal process if such person knowingly sends or delivers to another any document falsely purporting to be an order or other document that simulates civil or criminal process.
B. Simulating legal process is a class 2 misdemeanor.
This document, signed by the county attorney, had NOT been filed with the court. I beat Johnson and Frausto back to town hall, and the judge appeared irritated with the situation for whatever it’s worth.

My question is, if it’s the town of Quartzite issuing this document, why are they using The State Of Arizona? No Case Number, Complaint etc? This looks more like harassment to me. If this town is using the State Of Arizona as it’s bully tactic, next question is: Is this legal? And if it’s not legal, can charges be pressed against the violator? I’ve been following this case since last summer when it broke. This town is totally outside of Constitutional law in my humble opinion. The rest of us around the country support Jade and denounce the oppression she is facing because she dared to use her First Amendment privilege. Shame on you Quartzite. I guess since that last joke of an election you probably won by intimidation gives you the power. They tried that in the seventies rural Tennessee with Bufford Pusser, it took a big man with a big stick to bring back justice. Crony politicians suck from the bottom up.

That is NOT a legal summons. I am not an AZ native, and have not become intimate with legal processes here, however, a Court summons would contain the case #, appearance date, etc.
Harassment charges, anyone?
