Foster Elected Again

Sure, Ed Foster was elected by the people of Quartzsite last May. He had to be “elected” a second time in court. That happened yesterday. READ COMPLETE STORY AT PARKER PIONEER

These events thanks to a stubborn Quartzsite Town Council.  Many thousands of dollars were spent on lawyers to bring a losing argument to court that the people had elected an “unqulaified” mayor. The council stood by an illegal town ordinance – to deny the people their elected representative. All the while, the council could have simply brought the faulty ordinance to a meeting and struck it. Instead, according to council member Norma Crooks, it had to be “tested in court”. The hard way. At the expense of the taxpayers. Crooks and the other council members obviously refused to take their attorney’s advice and settle the lo$ing ca$e!

Sadly, other faulty ordinances still exist on Quartzsite’s books. Will this council insist on “testing” them all?

    Two laws of possible interest:

    38-431.05. Meeting held in violation of article; business transacted null and void; ratification

    A. All legal action transacted by any public body during a meeting held in violation of any provision of this article is null and void except as provided in subsection B. . . .

    And A.R.S. 16-1010, mentioned by others in the past before: Refusal by election officer to perform duty; violation of election law; classification

    “A person charged with performance of any duty under any law relating to elections who knowingly refuses to perform such duty, or who, in his official capacity, knowingly acts in violation of any provision of such law, is guilty of a class 6 felony unless a different punishment for such act or omission is prescribed by law.”

    Tom Horne where are you? You have means, motive, and opportunity. It’s all in the record. The “dissidents” will help your investigators find it all.

    Others have stated it, but I wanted to echo here. The judge’s ruling means that the appointment of Norma Crooks as council member was done in an illegal meeting (no quorum of actually elected council members, since Orgeron, Workman, and Foster were not seated). Therefore, her appointment and EVERY issue she has voted on is now void and must be reaffirmed. This includes both of the ad-hoc actions against Mrs. Workman, the assignment of a “chair and vice-chair,” the hiring of Mrs. Bruno, and the reinstatement of Chief Gilbert.

    I suggest that resolving this should be the first agenda items at the earliest possible date. The “opposition candidates” would be best served to have an alternate name to nominate for the open council seat (Prutch perhaps? or Jones?). Wouldn’t that be something!!

    Remember the movie (and book) “Love Story”? (I’m dating myself.) Well, Erich Segal was wrong. Love DOES mean having to say you’re sorry.

    Unfortunately, I’m not seeing any love from the incumbent Town Council members.

    For example. they besmirched the reputation of Shelly Baker when they made all sorts of baseless claims about voter fraud in Quartzsite. Which their own (illegal) investigation showed were false. (i.e., lies.) But, to the best of my knowledge, no one has told Shelly Baker they are sorry.

    Then they trashed Mayor Ed Foster. What’s especially ridiculous is that, even if their illegal ordinance had been legal, even in the best case, their ordinance did not prohibit Ed from being seated. This whole exercise was frivolous and must have had a more sinister motive. (Personally, I think a criminal case could be made here for violation of A.R.S. S 38-503, Conflict of Interest, a Class 6 felony. And conspiracy too?)

    And even after Quartzsite shill Judge Burke ruled against the Town, I’ve not heard anyone from the Town Council tell Ed they’re sorry. (Notice how Burke didn’t force the Town to pay double damages?)

    I’m reminded of a passage from the Bible which describes the characteristics of Godless people: “They are gossips, slanderers, God-haters, insolent, arrogant and boastful; they invent ways of doing evil; they disobey their parents; they are senseless, faithless, heartless, ruthless.”

    The heart of the problem in Quartzsite is a problem of the heart.
